Full SMS Terms

By "Opting In" to or using a "Text Message Service" (as defined below) from Sparks Media Studios LLC, you accept these Terms & Conditions.

This agreement is between you and Sparks Media Studios LLC or one of its affiliates. All references to "Sparks Media Studios," "we," "our," or "us" refer to Sparks Media Studios LLC, PO Box 505 Tuttle, OK 73089.

Definitions

"Opting In," "Opt In," and "Opt-In" refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.

"Text Message Service" means arrangements in which we send plain written text messages using SMS (standard text on your mobile number). We do not send picture messages (MMS), group marketing blasts, or rich-media campaigns through this service—only the conversational SMS text messages described here.

Description of the Service

Sparks Media Studios uses Microsoft Teams to send direct, conversational text messages (SMS only) between our principal and our clients, prospective clients, and authorized client contacts. Messages may include:

  • Project updates and status communications related to active client engagements
  • Appointment, meeting, and call confirmations or reminders
  • Replies to questions you send us about your project or our services

This Text Message Service is not used for marketing, promotional, bulk, or automated commercial messaging.

How You Opt In

You may opt in to receive text messages from Sparks Media Studios LLC in any of the following ways:

  • By contacting us first. If you initiate a text message to a Sparks Media Studios phone number, you have opted in to receive a reply.
  • By providing verbal or written consent during onboarding. During a discovery call, kickoff meeting, or contract execution, we may ask whether you wish to receive project communications by text message. Your "yes" (verbal or in writing, including by email) constitutes opt-in.
  • By submitting a web form on our website. If you provide your mobile phone number using this page's web opt-in form for text messages — or using our general contact form — and check the consent to receive texts box for that form, you are opting in to receive text messages from us.

By opting in, you confirm that you are the subscriber or the customary user of the mobile phone number you provided, or that you are authorized to provide that number for this purpose.

Consenting to Text Messaging

By consenting to receive text messages from us, you agree to these Text Messaging Terms and Conditions, as well as our Website Terms and Conditions and our Privacy Policy, incorporated herein by reference.

E-Sign Disclosure

By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying STOP.

Sparks Media Studios Text Message Service Privacy Policy

We respect your privacy. We only use information you provide through this service to transmit your text messages and respond to you. This includes, but isn't limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of text messages. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Nonetheless, we reserve the right always to disclose any information as necessary to satisfy any law, regulation, or governmental request, to avoid liability, or to protect our rights or property.

This Text Message Service Privacy Policy applies to your use of the Text Message Service and isn't intended to modify our general Privacy Policy, incorporated by reference above, which may govern the relationship between you and us in other contexts.

Costs of Text Messages

We do not charge you for the messages you send and receive via this text message service. Message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.

Message Frequency

Message frequency varies. This Text Messaging Service is for conversational person-to-person communication between you and Sparks Media Studios. There is no recurring or scheduled message program. The number of messages you receive depends on the activity in your engagement and your interactions with us. On average, recipients can expect fewer than 10 messages per week, though actual volume varies. Msg & data rates may apply.

Help

For help, reply HELP to any of our text messages or contact us at [email protected]. You will receive an automated reply with support contact information.

How to Opt Out (Unsubscribe)

If you no longer want to receive text messages, you may reply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. As a person-to-person communication service, opt-out requests are specific to each conversation between you and a Sparks Media Studios employee or principal and their associated phone number. After unsubscribing, we may send you a confirmation of your opt-out via text message. To resume receiving messages after opting out, reply START.

Changes to These Terms

We reserve the right to update or modify these Text Messaging Terms of Use and Privacy Policy at any time. Any changes will be posted to this page with an updated effective date. Your continued use of the Text Message Service after any changes are posted constitutes your acceptance of the revised terms.
